NETCLOAK VPN TERMS OF USE

1. ACCEPTANCE OF TERMS

1.1 Agreement

By accessing or using the NetCloak VPN service (“Service”), you agree to be bound by these Terms of Use (“Terms”). If you do not agree to these Terms, do not use the Service.

1.2 Age Requirement

You must be at least 18 years old to use this Service. If you are under 18, you may only use the Service with parental or guardian consent and supervision.

1.3 Updates to Terms

We reserve the right to update these Terms at any time. We will notify you of significant changes through the app. Your continued use of the Service after changes constitutes acceptance of the new Terms.

2. SERVICE DESCRIPTION

2.1 What We Provide

NetCloak is a free VPN service for Android, using the WireGuard protocol. It provides an encrypted connection through servers we operate. It is supported by advertising, although how often an advertisement appears is a setting we control remotely and can set to zero.

2.2 Connection Modes

Sessions are bounded by time, not by a data allowance. Before connecting you pick a mode, which trades speed against how long the session lasts:

• Marathon: 80 minutes at the base speed
• Balanced: 40 minutes at twice the base speed — the default
• Sprint: 20 minutes at four times the base speed

Watching a rewarded advertisement adds another block of your mode’s length to whatever time is left. Remaining time is capped at 180 minutes, so an extension may add less than a full block, or nothing at all, and the app will tell you when that happens.

The app warns you as a session runs low: our server marks it “low” between 5% and 15% of the window remaining and “critical” at 5% or less. Those warnings prompt you to extend; they do not end the session.

2.3 Fair Use

There is no data allowance to spend and none is shown in the app. Transfer volume is measured only against an anti-abuse ceiling of 10 GB per session, which exists so a single session cannot exhaust a shared server.

2.4 Ad-Supported Model

Extending a session may require watching a rewarded video advertisement served by Google AdMob. The reward is granted at Google’s own threshold for the advertisement. How often an advertisement is required is set remotely and can be zero, in which case extensions are granted without one.

2.5 Server Infrastructure

• Servers are selected automatically by availability and capacity
• Manual server selection is not offered
• Server capacity is finite, and a connection attempt can be refused when a server is full
• Service availability depends on that capacity

3. ACCOUNT & ACCESS

3.1 Anonymous Authentication

• No registration, account, email address or password is required
• Our own backend issues an access token, which the app stores in Android Keystore-backed encrypted storage
• The identifier inside that token is anonymous and is not tied to your identity
• There is no account recovery, because there is no account

3.2 Session Management

• A session lasts for the length of the mode you chose, and our server decides when it expires
• Sessions can be extended, subject to the 180-minute cap in §2.2
• One session per user is active at a time
• The app checks the remaining time about every 30 seconds, and disconnects roughly 30 seconds before expiry so you are not cut off mid-transfer
• If the tunnel stops responding, the app ends the session and tells you, rather than continuing to show a connection that carries nothing

3.3 When We End a Session Early

Your session may be ended before its time is up if:

• its time has run out
• the tunnel has gone idle, with no WireGuard handshake for five minutes
• the session was created but never connected within three minutes
• you started a newer session, which supersedes the older one
• the server is under capacity pressure and is reclaiming space
• a peer has been left behind by a failure and is no longer attached to a live session

Reconnecting after any of these starts a new session.

4. ACCEPTABLE USE POLICY

4.1 Prohibited Activities

You agree NOT to use the Service to:

• Engage in any illegal activities under your local, state, national, or international laws
• Transmit or access illegal content
• Perform network attacks, hacking, or other malicious activities
• Infringe on copyrights, trademarks, or other intellectual property rights
• Engage in piracy or unauthorized content distribution
• Send spam, phishing attempts, or conduct fraudulent activities
• Attempt to circumvent service limitations or restrictions
• Block, skip, or manipulate advertisement viewing, or claim a reward for an advertisement that was not watched
• Share, resell, or commercialize the Service
• Violate the privacy or rights of others
• Use the Service for commercial or business purposes

4.2 Rate Limiting

• Creating or extending a session is limited to 5 requests a minute per address
• Checking session status is limited to 30 requests a minute per address
• Excessive requests may result in temporary blocks
• The fair-use ceiling in §2.3 applies to prevent system abuse

4.3 Enforcement

We reserve the right to:

• Terminate or suspend access for Terms violations
• Cooperate with law enforcement when required by law
• Block access from specific regions if necessary

5. ADVERTISEMENTS

5.1 Rewarded Video

• Advertisements are rewarded videos provided by Google AdMob, a third-party service
• The reward that extends your session is granted at Google’s threshold for that advertisement
• We do not control advertisement content
• How often an advertisement is required is set remotely and may be zero

5.2 Consent

Before personalised advertising, the app asks for your consent through Google’s User Messaging Platform. You can change or withdraw that choice from the app’s privacy options at any time.

5.3 Reward Verification

When a verified reward is requested, the app attaches a random single-use number and the anonymous identifier from your access token to the advertisement, and Google confirms to our server that the reward was earned. This exists so that an extension cannot be granted to an automated request. Server-side enforcement is currently switched off.

5.4 Ad Interaction

• Do not use ad-blocking software or techniques
• Do not engage in fraudulent ad interactions
• Do not attempt to manipulate the ad reward system

6. PRIVACY & DATA

6.1 Data Collection

• Only the operational data needed to run a session is collected
• No browsing activity, DNS queries or traffic content is logged
• Session metadata, including when a session was created, extended and due to expire, is stored while the session exists and deleted when it ends
• Authentication uses an anonymous token issued by our own backend

6.2 Third-Party Services

• Google AdMob, for advertisements, and Google’s User Messaging Platform, for consent
• Contabo GmbH, a German hosting company, for the VPN servers
• Cloudflare, for the DNS-over-HTTPS resolver the app queries
• Google Play, for distribution
• Each of these has its own privacy policy

7. SERVICE LIMITATIONS

7.1 Availability

• Service provided “as available” with no uptime guarantees
• Server capacity is finite and connections may be refused, or sessions reclaimed, when a server is under pressure
• Maintenance may occur without notice
• Service may be discontinued at any time

7.2 Performance

The speed of your mode is a ceiling we apply, not a guarantee. Actual speeds may vary based on:

• Network conditions
• Server load
• Geographic location
• Internet service provider
• Device capabilities

7.3 Security Limitations

• VPN improves privacy but does not guarantee complete anonymity
• Cannot guarantee access to geo-restricted content
• Does not protect against all security threats
• User responsible for additional security measures

8. TECHNICAL REQUIREMENTS

8.1 Client Requirements

• An Android device running API level 26 (Android 8.0) or later
• Stable internet connection
• Sufficient device resources
• Required permissions: internet access, network state, VPN service, foreground service, notifications (Android 13+), advertising ID

8.2 Network Compatibility

• An HTTPS connection to our API is required, in addition to the WireGuard tunnel itself
• You are responsible for ensuring your network permits them
• Some networks block VPN protocols
• DNS-over-HTTPS is used for server discovery and configuration

9. DISCLAIMERS & WARRANTIES

9.1 "AS IS" Service

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

9.2 No Guarantees

We do not guarantee:

• Uninterrupted or error-free service
• Complete security or privacy
• Access to all websites or services
• Specific connection speeds
• Protection from all threats

10. LIMITATION OF LIABILITY

10.1 No Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NETCLOAK SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

10.2 Maximum Liability

Our total liability for any claims under these Terms is limited to $0 (zero dollars) as this is a free service.

10.3 User Responsibility

You are solely responsible for:

• Compliance with all applicable laws
• Your online activities while using the Service
• Any consequences of Terms violations

11. INDEMNIFICATION

You agree to indemnify and hold NetCloak harmless from any claims, losses, damages, liabilities, including legal fees, arising from your use of the Service or violation of these Terms.

12. TERMINATION

12.1 User Termination

You may stop using the Service at any time by uninstalling the application.

12.2 Service Termination

We may terminate or suspend your access immediately, without prior notice, for:

• Terms violations
• Legal requirements
• Service discontinuation
• Technical or security reasons

Ending an individual session for one of the operational reasons in §3.3 is not a termination of your access, and you may reconnect.

12.3 Effect of Termination

Upon termination:

• Your VPN sessions will end
• No refunds applicable (free service)
• Terms sections that should survive will remain in effect

13. GOVERNING LAW & DISPUTES

13.1 Governing Law

These Terms are governed by the laws of California, United States, without regard to conflict of law principles.

13.2 Dispute Resolution

• Attempt informal resolution first by contacting support
• Binding arbitration for unresolved disputes
• Class action waiver: no class or representative actions

13.3 Jurisdiction

Exclusive jurisdiction in courts of Los Angeles County, California for any disputes not subject to arbitration.

14. GENERAL PROVISIONS

14.1 Entire Agreement

These Terms constitute the entire agreement between you and NetCloak regarding the Service.

14.2 Severability

If any provision is found unenforceable, the remaining provisions will continue in effect.

14.3 No Waiver

Our failure to enforce any right or provision is not a waiver of that right or provision.

14.4 Assignment

You may not assign these Terms. We may assign our rights to any successor or affiliate.

16. SPECIFIC PROVISIONS

16.1 Export Controls

The Service may not be used in violation of U.S. export laws and regulations.

16.2 Sanctions Compliance

Service not available in countries subject to U.S. sanctions.

16.3 DMCA Compliance

We respond to valid DMCA takedown notices in accordance with applicable law.

17. DEFINITIONS

• “Service”: the NetCloak VPN application and the backend infrastructure behind it
• “Session”: one VPN connection, lasting for the length of the mode it was created with
• “Connection Mode”: Marathon, Balanced or Sprint, each trading speed against session length as described in §2.2
• “Extension”: additional time added to a session, subject to the 180-minute cap on remaining time
• “Fair-Use Ceiling”: the 10 GB per session anti-abuse limit described in §2.3
• “Warning Level”: the server’s signal that a session is running low — low at 5–15% of the window remaining, critical at 5% or less
• “User”: any person using the Service
• “Ad”: a rewarded video advertisement from Google AdMob
