1. ACCEPTANCE OF TERMS

1.1 Agreement

By accessing or using the NetCloak VPN service ("Service"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the Service.

1.2 Age Requirement

You must be at least 18 years old to use this Service. If you are under 18, you may only use the Service with parental or guardian consent and supervision.

1.3 Updates to Terms

We reserve the right to update these Terms at any time. We will notify you of significant changes through the app. Your continued use of the Service after changes constitutes acceptance of the new Terms.

2. SERVICE DESCRIPTION

2.1 What We Provide

NetCloak is a free, ad-supported VPN service using the WireGuard protocol. The Service provides encrypted internet connections through our server infrastructure.

2.2 Service Tier

The Service offers a single free tier with data quota limits:

• Free Tier: 20 Mbps download/upload, 24-hour sessions, 1.05GB data limit per session
• Data Extension: Watch advertisements to add 500MB data quota to your session
• Grace Period: 5 minutes of continued access after data limit is exceeded
• Warning System: Proactive alerts at 15% (Low) and 5% (Critical) remaining data/time

2.3 Ad-Supported Model

Access to the Service requires viewing video advertisements (minimum 8 seconds) through Google AdMob. This is how we keep the Service free.

2.4 Server Infrastructure

• Automatic server selection based on availability and capacity
• No manual server selection available
• Servers may reach capacity (100 concurrent users per server)
• Service availability depends on server capacity

3. ACCOUNT & ACCESS

3.1 Anonymous Authentication

• No registration or personal account required
• Firebase anonymous authentication used for session management
• No account recovery possible (anonymous system)
• Each device generates unique anonymous identifiers

3.2 Session Management

• VPN sessions last 24 hours with 1.05GB data quota
• Sessions can be extended by watching advertisements (adds 24 hours + 500MB data)
• Extensions are cumulative - time and data add to your remaining balance
• One active session per user at a time
• Sessions automatically terminate when time expires or data limit is exceeded (after 5-minute grace period)
• Real-time monitoring: Client-side tracking every 10 seconds, server-side verification every 30 seconds

4. ACCEPTABLE USE POLICY

4.1 Prohibited Activities

You agree NOT to use the Service to:

• Engage in any illegal activities under your local, state, national, or international laws
• Transmit or access illegal content
• Perform network attacks, hacking, or other malicious activities
• Infringe on copyrights, trademarks, or other intellectual property rights
• Engage in piracy or unauthorized content distribution
• Send spam, phishing attempts, or conduct fraudulent activities
• Attempt to circumvent service limitations or restrictions
• Block, skip, or manipulate advertisement viewing
• Share, resell, or commercialize the Service
• Violate the privacy or rights of others
• Use the Service for commercial or business purposes

4.2 Rate Limiting

• API requests limited to 5 per minute per user for session operations
• Excessive requests may result in temporary blocks
• Fair use policy applies to prevent system abuse

4.3 Enforcement

We reserve the right to:

• Terminate or suspend access for Terms violations
• Cooperate with law enforcement when required by law
• Block access from specific regions if necessary

5. ADVERTISEMENTS

5.1 Required Viewing

• Complete advertisement viewing (minimum 8 seconds) required for service access
• Advertisements provided by Google AdMob (third-party service)
• We do not control advertisement content

5.2 Ad Interaction

• Do not use ad-blocking software or techniques
• Do not engage in fraudulent ad interactions
• Do not attempt to manipulate the ad reward system

6. PRIVACY & DATA

6.1 Data Collection

• Minimal operational data collected for service functionality
• No browsing activity or traffic content logged
• Session metadata (creation, extension, expiration) stored temporarily
• Anonymous Firebase authentication tokens used

6.2 Third-Party Services

• Google AdMob for advertisement delivery
• Firebase for anonymous authentication
• These services have their own privacy policies

7. SERVICE LIMITATIONS

7.1 Availability

• Service provided "as available" with no uptime guarantees
• Server capacity limited to 100 concurrent users per server
• Maintenance may occur without notice
• Service may be discontinued at any time

7.2 Performance

Actual speeds may vary based on:

• Network conditions
• Server load
• Geographic location
• Internet service provider
• Device capabilities

7.3 Security Limitations

• VPN improves privacy but does not guarantee complete anonymity
• Cannot guarantee access to geo-restricted content
• Does not protect against all security threats
• User responsible for additional security measures

8. TECHNICAL REQUIREMENTS

8.1 Client Requirements

• Android device with minimum API level 26 (Android 8.0+)
• Stable internet connection
• Sufficient device resources
• Required permissions: Internet access, Network state, VPN service, Foreground service, Notifications (Android 13+), Advertising ID

8.2 Network Compatibility

• HTTPS connection on port 8443 required
• User responsible for ensuring network compatibility
• Some networks may block VPN protocols
• DNS-over-HTTPS (DoH) used for server discovery and configuration

9. DISCLAIMERS & WARRANTIES

9.1 "AS IS" Service

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

9.2 No Guarantees

We do not guarantee:

• Uninterrupted or error-free service
• Complete security or privacy
• Access to all websites or services
• Specific connection speeds
• Protection from all threats

10. LIMITATION OF LIABILITY

10.1 No Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NETCLOAK SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

10.2 Maximum Liability

Our total liability for any claims under these Terms is limited to $0 (zero dollars) as this is a free service.

10.3 User Responsibility

You are solely responsible for:

• Compliance with all applicable laws
• Your online activities while using the Service
• Any consequences of Terms violations

11. INDEMNIFICATION

You agree to indemnify and hold NetCloak harmless from any claims, losses, damages, liabilities, including legal fees, arising from your use of the Service or violation of these Terms.

12. TERMINATION

12.1 User Termination

You may stop using the Service at any time by uninstalling the application.

12.2 Service Termination

We may terminate or suspend your access immediately, without prior notice, for:

• Terms violations
• Legal requirements
• Service discontinuation
• Technical or security reasons

12.3 Effect of Termination

Upon termination:

• Your VPN sessions will end
• No refunds applicable (free service)
• Terms sections that should survive will remain in effect

13. GOVERNING LAW & DISPUTES

13.1 Governing Law

These Terms are governed by the laws of California, United States, without regard to conflict of law principles.

13.2 Dispute Resolution

• Attempt informal resolution first by contacting support
• Binding arbitration for unresolved disputes
• Class action waiver: no class or representative actions

13.3 Jurisdiction

Exclusive jurisdiction in courts of Los Angeles County, California for any disputes not subject to arbitration.

14. GENERAL PROVISIONS

14.1 Entire Agreement

These Terms constitute the entire agreement between you and NetCloak regarding the Service.

14.2 Severability

If any provision is found unenforceable, the remaining provisions will continue in effect.

14.3 No Waiver

Our failure to enforce any right or provision is not a waiver of that right or provision.

14.4 Assignment

You may not assign these Terms. We may assign our rights to any successor or affiliate.

• "Service": The NetCloak VPN application and associated backend infrastructure
• "Session": A VPN connection with 24-hour duration and 1.05GB data quota, established after ad viewing
• "Free Tier": The single service tier offering 20 Mbps bandwidth, 24-hour sessions, and 1.05GB data limit
• "Data Extension": Additional 500MB data quota added to session by watching an advertisement
• "Grace Period": 5-minute period of continued access after data limit is exceeded
• "Warning Level": Proactive alerts (Low at 15% remaining, Critical at 5% remaining)
• "User": Any person using the Service
• "Ad": Video advertisement from Google AdMob (minimum 8 seconds viewing required)
