Kalum Terms of Use
Welcome to Kalum. These Terms of Use ("Terms") govern your access to and use of the Kalum mobile application and related services (collectively, the "Service"), operated by NeuEra Apps ("we," "our," or "us").
Please read these Terms carefully. By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Acceptance of Terms
By creating an account, accessing, or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. We may modify these Terms from time to time as described in Section 19. Material changes will be communicated in the app and, where applicable, by email. Your continued use of the Service after the effective date of a change constitutes acceptance of the modified Terms.
2. Eligibility
To use the Service, you must:
- Be at least 18 years of age.
- Have the legal capacity to enter into a binding agreement.
- Reside in a country where Kalum is offered. Account registration currently requires a country supported by our payment processor; the list of supported countries is shown in the app at the time of registration.
- Not be prohibited from using the Service under applicable law (including U.S., EU, UK, and other applicable trade-sanctions and export-control laws).
By using the Service, you represent and warrant that you meet all eligibility requirements.
3. Account Registration
3.1 Creating an Account
You create an account by verifying your phone number through Firebase Authentication (Google). You agree to:
- Provide accurate, current, and complete information.
- Maintain the security of your phone number, your device, and any device-bound credentials.
- Notify us immediately at support@kalum.app of any unauthorized access to your account.
- Accept responsibility for all activity under your account, including all calls placed and all credits consumed.
3.2 One Account Per Person
You may hold only one Kalum account. Creating multiple accounts may result in suspension or termination of all of your accounts.
3.3 Account Security
You are responsible for safeguarding access to your account. We are not liable for any loss or damage arising from your failure to maintain that security, including unauthorized use that occurs because someone else has access to your phone number, device, or SIM.
3.4 Anti-Fraud Controls
To protect users and the Service, we may apply automated and manual controls including:
- Velocity limits on call frequency, hourly spend, and the number of unique destinations called per hour.
- A limit of two (2) concurrent active calls per account.
- Restrictions on calls to certain destinations from accounts that are less than 24 hours old.
- Account suspension or banning where activity matches patterns of telecommunications fraud (including International Revenue Share Fraud).
These controls are explained at a high level in our Privacy Policy and are subject to change without notice as the threat landscape evolves.
4. The Service
Kalum is a prepaid Voice over Internet Protocol (VoIP) calling service that enables you to place outbound voice calls to telephone numbers worldwide.
4.1 What Kalum Provides
- Outbound voice calls to 216+ destination countries routed via the public switched telephone network through our partner Twilio.
- Per-minute prepaid calling with no subscriptions and no contracts.
- Per-call rate display before you connect.
- Call history and transaction history within the app.
- Secure payment processing through Stripe, including support for Apple Pay (iOS) and Google Pay (Android) where available.
4.2 What Kalum Does Not Provide
- Inbound calls (you cannot receive calls on a Kalum number).
- SMS or MMS messaging.
- Conference calling.
- Call recording or voicemail.
- Calls to certain numbers blocked by our carrier or by law (including premium-rate, satellite, and certain sanctioned destinations).
- Emergency calling (see Section 9).
4.3 Service Availability
We aim to keep the Service available, but we do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, upgrades, third-party outages, or events beyond our reasonable control.
5. Billing and Payment
5.1 Prepaid Credit Model
Kalum is a strict prepaid service. You must purchase credits before placing a call. Credits are added to your account immediately on successful payment.
5.2 Credit Packages
| Package | Price (USD) | Credits Received |
|---|---|---|
| Starter | $2.00 | $2.00 |
| Standard | $10.00 | $10.00 |
| Premium | $25.00 | $25.00 |
Prices are in U.S. dollars and may be displayed in your local currency by your platform's payment system. Currency conversion and applicable taxes are handled by Apple, Google, or Stripe as the case may be.
5.3 Call Rates
- Per-minute rates vary by destination and are displayed in the app before you initiate a call.
- We may revise rates at any time to reflect changes from our underlying carriers. New rates apply only to calls placed after the rate change. The rate shown in the app at the moment you start a call is the rate that will be applied to that call.
5.4 How Calls Are Billed
- Connected calls are billed in one-minute increments, rounded up to the next whole minute. A 1-second call is billed at one minute; a 121-second call is billed at three minutes.
- A minimum of one minute is charged for any connected call.
- Credits are deducted after the call ends; we do not reserve credits during the call.
- All call attempts are billed, including unanswered, busy, and failed attempts, because our underlying carrier (Twilio) charges us per attempt regardless of answer state. The amount billed for an unanswered call is the one-minute minimum at the destination's rate.
- Calls to destinations not listed in our rate table are billed at a fallback rate of $0.50 per minute. If you encounter this rate for a destination you believe should be listed, please contact support@kalum.app.
5.5 Minimum Balance to Place a Call
To place a call, your account balance must be at least 1.5 times the per-minute rate for that destination (i.e., enough credit for ninety seconds of conversation). This is a safety margin against fraud and against running out of credit during a billable minute.
5.6 Credits Do Not Expire
Purchased credits remain in your account indefinitely as long as your account remains active. Credits are not transferable, have no cash value, and may not be exchanged for cash except as required by applicable law or as expressly provided in Section 6.
5.7 Payment Methods
- Credit and debit cards processed by Stripe.
- Apple Pay (iOS) and Google Pay (Android), where supported by your device, processed through Stripe.
- We never receive your full card number, expiry, or CVV. Your payment information is submitted directly to Stripe.
5.8 Taxes
Prices listed in the app exclude any sales tax, VAT, GST, telecommunications tax, or similar levy unless otherwise stated. You are responsible for any applicable taxes that arise from your use of the Service.
6. Refund Policy
6.1 General Rule
Credits are sold on a prepaid basis and, except as provided in this Section 6 or as required by applicable law (including, where applicable, EU/UK consumer-protection rights), all sales are final.
6.2 7-Day Discretionary Refund Window
You may request a refund of unused credits within seven (7) days of purchase, subject to all of the following:
- The credits from the purchase have not been used for any call.
- You make the request from the phone number associated with your account.
- You have not previously received a refund for the same purchase.
- We have not suspended or banned your account for violation of these Terms.
6.3 Non-Refundable Items
- Credits used for any completed or attempted call.
- Partial balances from a partially used purchase.
- Purchases older than seven (7) days, except as required by applicable law.
- Currency-conversion fees, transaction fees, or taxes assessed by Apple, Google, or your card issuer.
6.4 How to Request a Refund
- Email support@kalum.app within seven (7) days of the purchase.
- Include your account phone number and the transaction details (date, amount, last 4 of card if applicable).
- Approved refunds are returned to the original payment method, typically within 5–10 business days. The exact timing depends on your bank, card issuer, or platform.
6.5 EEA / UK Consumers — Right of Withdrawal
If you are a consumer in the EEA or the United Kingdom, you have a statutory right to withdraw from your purchase within fourteen (14) days, subject to the conditions of applicable consumer-protection law. By initiating a call within that period, you expressly request that performance begin immediately and you acknowledge that you will lose the right of withdrawal once the digital content (your credits) is fully used.
6.6 Account Closure
If you close your account, only credits purchased within the previous seven (7) days may be refunded under Section 6.2. Older credits are forfeited unless applicable law requires otherwise.
7. Acceptable Use and Prohibited Conduct
You agree not to use the Service to:
7.1 Illegal Activity
- Engage in any activity that violates local, state, national, or international law.
- Harass, threaten, defraud, stalk, or intimidate any person.
- Transmit content that is fraudulent, defamatory, obscene, or otherwise unlawful.
- Impersonate any person or entity or misrepresent your affiliation.
7.2 Technical Abuse
- Use bots, scripts, or other automated means to place calls.
- Attempt to gain unauthorized access to our systems or to other users' accounts.
- Interfere with, disrupt, or impose unreasonable load on the Service.
- Reverse engineer, decompile, or disassemble the Service except to the extent permitted by applicable law.
- Circumvent rate limits, fraud controls, or other security measures.
7.3 Commercial Misuse
- Resell, redistribute, or commercially exploit the Service without our prior written authorization.
- Use the Service for telemarketing, robocalls, mass dialing, or auto-dialed campaigns.
- Use the Service to operate a call center, virtual PBX, or business-line replacement without our prior written authorization.
7.4 Telecommunications Violations
- Make calls in violation of any applicable telecommunications regulation, including those of the originating or destination jurisdiction.
- Engage in caller-ID spoofing or otherwise misrepresent the origin of a call.
- Use the Service to place calls in connection with International Revenue Share Fraud, "Wangiri" callback fraud, or other carrier-fraud schemes.
Violation of this Section 7 may result in immediate account suspension or termination, forfeiture of remaining credits, and reporting to law enforcement.
8. Number Access and Restrictions
We rely on Twilio for outbound call routing. Calls to certain numbers are not supported, including:
- Emergency services (see Section 9).
- Premium-rate, satellite, and certain international shared-cost numbers.
- Destinations subject to U.S., EU, UK, or other applicable trade sanctions (which may, from time to time, include destinations such as Iran, Cuba, Syria, North Korea, and certain regions of Ukraine and Russia, in line with our carrier's policies).
- Any destination temporarily blocked by our fraud controls.
The list of restricted destinations may change at any time without notice.
9. Emergency Services Disclaimer
KALUM IS NOT A REPLACEMENT FOR TRADITIONAL TELEPHONE SERVICE AND CANNOT BE USED FOR EMERGENCY CALLS.
9.1 No Emergency Calling
The Service does not support calls to emergency services, including but not limited to:
- 911 (United States, Canada)
- 112 (European Union, United Kingdom)
- 999 (United Kingdom, Ireland, parts of Asia)
- 000 (Australia)
- All other local emergency numbers worldwide
Calls to emergency numbers will not connect.
9.2 Your Responsibility
You must maintain access to a traditional telephone service (mobile or landline) or another reliable means of contacting emergency services. Do not rely on Kalum for emergency communications.
9.3 Limitation of Liability
To the maximum extent permitted by law, we are not liable for any damages, injuries, or losses arising from your inability to reach emergency services through the Service.
10. Intellectual Property
10.1 Our Property
The Service, including its design, features, software, content, and "Kalum" branding, is owned by NeuEra Apps and is protected by copyright, trademark, and other intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal, non-commercial use, subject to these Terms.
10.2 Trademarks
"Kalum" and the Kalum logo are trademarks of NeuEra Apps. You may not use them without our prior written consent.
10.3 Feedback
If you send us feedback, suggestions, or ideas about the Service, you grant us a non-exclusive, royalty-free, worldwide, perpetual license to use that feedback for any purpose without obligation to you.
11. Third-Party Services
The Service integrates with third-party services as described in our Privacy Policy. Your use of those third-party services is also subject to their own terms and privacy policies. We are not responsible for the practices of third-party providers, except as described in our Privacy Policy with respect to data processing.
12. Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY.
We do not warrant that:
- The Service will be uninterrupted, timely, secure, or error-free.
- Call quality, latency, or completion rates will meet your expectations.
- All calls will connect successfully.
- Defects will be corrected.
Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you. In that case, the warranties are limited to the minimum scope and duration required by law.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:
13.1 Exclusion of Indirect Damages
We will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, data, goodwill, or business opportunity, arising out of or related to your use of (or inability to use) the Service, even if we have been advised of the possibility of such damages.
13.2 Cap on Direct Damages
Our total cumulative liability arising out of or relating to the Service or these Terms shall not exceed the greater of (a) the amount you paid to us for the Service in the six (6) months immediately preceding the event giving rise to the claim, or (b) one hundred U.S. dollars (USD $100).
13.3 Basis of the Bargain
The limitations and exclusions in this Section 13 apply regardless of the legal theory (contract, tort, strict liability, or otherwise) and form an essential part of the bargain between you and NeuEra Apps.
13.4 Mandatory Local Law
Nothing in these Terms is intended to limit any right or remedy you may have under applicable consumer-protection law that cannot be lawfully waived. If you are a consumer in the EEA, the United Kingdom, or another jurisdiction with mandatory consumer-protection statutes, those statutes prevail to the extent of any conflict.
14. Indemnification
You agree to defend, indemnify, and hold harmless NeuEra Apps, its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:
- Your use of the Service;
- Your violation of these Terms;
- Your violation of any rights of another party (including telecommunications regulations); or
- Any calls placed through your account.
15. Termination
15.1 By You
You may close your account at any time by contacting support@kalum.app. Upon closure:
- Credits purchased within seven (7) days may be refunded under Section 6.2.
- Older credits are forfeited.
- Your personal information will be deleted in accordance with our Privacy Policy, subject to financial-records retention periods.
15.2 By Us
We may suspend or terminate your account immediately, with or without notice, if:
- You materially breach these Terms.
- We reasonably suspect fraudulent, abusive, or unlawful activity in connection with your account.
- A chargeback, payment dispute, or unrecoverable refund occurs on a transaction tied to your account.
- We are required to do so by law or by a competent authority.
- We discontinue the Service or a particular feature.
15.3 Effect of Termination
Upon termination, your right to use the Service ceases immediately. Provisions of these Terms that by their nature should survive termination will survive — including Sections 5, 6, 10, 12, 13, 14, 16, and 17.
16. Dispute Resolution
16.1 Informal Resolution
Before filing a formal legal action, you agree to first contact us at support@kalum.app and attempt to resolve the dispute informally. We will try to resolve the dispute within 30 days.
16.2 Binding Arbitration (Users in the United States)
If you are located in the United States, any dispute arising out of or relating to these Terms or the Service that is not resolved informally will be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration will be conducted in English. Judgment on the award may be entered in any court with jurisdiction.
16.3 Class Action Waiver (Users in the United States)
YOU AND NEUERA APPS AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE PROCEEDING. If this waiver is found to be unenforceable, then the entirety of Section 16.2 will be null and void as to the affected dispute.
16.4 Small-Claims Exception
You may bring an individual action in small-claims court for a dispute within that court's jurisdiction.
16.5 30-Day Opt-Out
You may opt out of Section 16.2 (Binding Arbitration) and Section 16.3 (Class Action Waiver) by emailing support@kalum.app within thirty (30) days of first accepting these Terms, with the subject line "Arbitration Opt-Out" and including your account phone number. Opting out will not affect any other provision of these Terms.
16.6 Users Outside the United States
If you are a consumer outside the United States, Sections 16.2 and 16.3 do not apply to you. You may bring claims in the courts of your country of residence to the extent required by mandatory local law.
17. Governing Law
These Terms are governed by the laws of the State of California, United States, excluding its conflict-of-laws rules. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
If you are a consumer in a jurisdiction whose mandatory consumer-protection law requires the application of local law, that local law applies to the extent required.
18. General Provisions
18.1 Entire Agreement
These Terms, together with our Privacy Policy, are the entire agreement between you and NeuEra Apps regarding the Service and supersede any prior agreements.
18.2 Severability
If any provision of these Terms is held to be unenforceable, the remaining provisions remain in full force and effect, and the unenforceable provision will be modified to the minimum extent necessary to be enforceable.
18.3 Waiver
Our failure to enforce any provision is not a waiver of our right to do so later.
18.4 Assignment
You may not assign or transfer these Terms without our prior written consent. We may assign our rights and obligations to an affiliate or to a successor in connection with a merger, acquisition, or sale of assets.
18.5 Force Majeure
We are not liable for any failure or delay in performance caused by circumstances beyond our reasonable control, including natural disasters, wars, terrorism, civil unrest, governmental action, internet outages, carrier failures, labor disputes, or pandemics.
18.6 Notices
We may give you notice via the app, the email address you provided, or by SMS to your registered phone number. You may give us notice at support@kalum.app.
18.7 Apple App Store / Google Play Additional Terms
If you obtained Kalum through the Apple App Store or Google Play, you also agree to the platform's terms. In the event of a conflict between platform terms and these Terms regarding the relationship between you and the platform operator, the platform terms control with respect to that relationship. You acknowledge that the platform operator has no obligation to provide maintenance and support for the Service and is not responsible for addressing any claims relating to the Service.
19. Changes to These Terms
We may update these Terms from time to time. When we do, we will:
- Post the updated Terms at legal.neuera.app/kalum/terms/.
- Update the "Last Updated" date and version number.
- Maintain prior versions in our public archive at /kalum/terms/archive.html.
- Notify you of material changes through the app and, where applicable, by email, at least 30 days before the change takes effect, unless a shorter period is required by law.
Your continued use of the Service after the effective date of a change constitutes acceptance of the updated Terms. If you do not agree, you must stop using the Service and may close your account under Section 15.1.
