1. ACCEPTANCE OF TERMS

By downloading, installing, or using Odometer - No-GPS Trip Log ("Odometer", "the App", "Service"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the App.

1.2 Age Requirement

There are no age restrictions for using Odometer. The App does not collect personal information, has no online features, and is safe for users of all ages.

1.3 Updates to Terms

We reserve the right to update these Terms at any time. Updated Terms will be posted on our legal documents portal at legal.neuera.app. Your continued use of the App after changes constitutes acceptance of the updated Terms.

1.4 Privacy Policy

These Terms are accompanied by our Privacy Policy, which explains how we handle data (spoiler: we don't collect any). By using the App, you also acknowledge our Privacy Policy.

2. SERVICE DESCRIPTION

2.1 What Odometer Provides

Odometer is a free, offline mileage tracking application for Android devices that allows you to:

• Manually log trips with start and end odometer readings
• Track vehicle-related expenses (fuel, tolls, parking, maintenance, car wash, other)
• Categorize trips as business or personal
• Calculate mileage deductions using IRS rates
• Manage multiple vehicles
• View monthly statistics and summaries
• Export data to CSV and PDF formats
• Import trip and expense data from CSV files

2.2 Offline-Only Operation

Odometer operates entirely offline:

• No internet connection required or used
• No cloud sync or backup features
• No user accounts or registration
• All data stored locally on your device

2.3 Free Service

Odometer is completely free:

• No purchase required
• No in-app purchases
• No premium features or subscriptions
• No advertisements
• All features available to all users

2.4 No GPS Tracking

Despite being a mileage tracking app, Odometer does not use GPS or location services. All mileage is calculated from odometer readings you manually enter. This is a deliberate privacy-first design choice.

3. USER RESPONSIBILITIES

3.1 Data Accuracy

You are solely responsible for:

• The accuracy of odometer readings you enter
• The accuracy of expense amounts and categories
• Correctly categorizing trips as business or personal
• Maintaining accurate records for tax or business purposes

3.2 Tax & Legal Compliance

IMPORTANT: Odometer is a record-keeping tool, not tax or legal advice. You are responsible for:

• Verifying IRS mileage rates are current and accurate
• Consulting with tax professionals about deduction eligibility
• Complying with all applicable tax laws and regulations
• Maintaining proper documentation for tax filings
• Understanding and following your employer's mileage reimbursement policies

3.3 Data Backup

Since all data is stored locally on your device, you are responsible for:

• Regularly exporting your data for backup purposes
• Safeguarding exported CSV and PDF files
• Understanding that uninstalling the App deletes all data
• Backing up data before device resets or changes

3.4 Device Security

You are responsible for maintaining the security of your device, including:

• Using appropriate screen locks and security measures
• Protecting your device from unauthorized access
• Understanding that anyone with device access can view your Odometer data

4. ACCEPTABLE USE

4.1 Permitted Uses

You may use Odometer for:

• Personal mileage and expense tracking
• Business mileage record-keeping
• Generating reports for reimbursement or tax purposes
• Managing vehicle-related expenses

4.2 Prohibited Uses

You agree NOT to:

• Reverse engineer, decompile, or disassemble the App
• Modify, adapt, or create derivative works of the App
• Distribute, sell, rent, or sublicense the App
• Use the App for any illegal purpose
• Create fraudulent mileage or expense records
• Use manipulated data from Odometer for fraudulent tax claims or reimbursements
• Remove or alter any copyright or proprietary notices

4.3 Record Integrity

You acknowledge that Odometer provides tools for record-keeping only. The accuracy and integrity of records depends entirely on your input. We do not verify or validate any data you enter.

5. DATA & PRIVACY

5.1 Local Storage Only

All data you enter into Odometer is stored locally on your device:

• Data is stored in a local SQLite database
• Data never leaves your device through the App
• We have no access to your data
• No data is transmitted to any servers

5.2 No Data Collection

Odometer does not collect:

• Personal information
• Usage analytics or telemetry
• Device identifiers
• Location data
• Any data whatsoever

5.3 Data Export

When you export data to CSV or PDF files:

• Files are saved to locations you choose on your device
• You control how exported files are shared or stored
• We have no access to exported files

6. INTELLECTUAL PROPERTY

6.1 Ownership

Odometer and all its components, including:

• Software, code, and technology
• User interface and design
• Graphics and visual elements
• Logos and branding

are owned by NeuEra Apps and protected by copyright, trademark, and other intellectual property laws.

6.2 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to:

• Download and install Odometer on your Android device(s)
• Use the App for personal or business record-keeping

This license does not include the right to modify, distribute, sell, or create derivative works.

6.3 Your Data

You retain all rights to the data you enter into Odometer. We claim no ownership of your trip records, expense data, or exported files.

7. DISCLAIMERS

7.1 "As Is" Service

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

7.2 No Tax or Legal Advice

ODOMETER IS A RECORD-KEEPING TOOL ONLY. IT DOES NOT PROVIDE TAX, LEGAL, OR FINANCIAL ADVICE. IRS MILEAGE RATES AND CALCULATION FEATURES ARE PROVIDED FOR CONVENIENCE ONLY. CONSULT QUALIFIED PROFESSIONALS FOR TAX AND LEGAL MATTERS.

7.3 No Guarantees

We do not guarantee:

• Error-free or bug-free operation
• Accuracy of calculations (verify all calculations independently)
• Compatibility with all Android devices
• Continued availability or support
• Suitability for any particular purpose

7.4 IRS Mileage Rates

IRS mileage rates shown in the App may not reflect the current official rates. You are responsible for verifying current rates with the IRS or your tax professional before using them for tax purposes.

8. LIMITATION OF LIABILITY

8.1 No Liability for Damages

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEUERA APPS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUES, DATA, USE, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

• Your use or inability to use the App
• Errors in calculations or data
• Loss of data due to device issues, uninstallation, or any other cause
• Tax penalties or issues arising from reliance on App data
• Denied reimbursements or deductions
• Any other matters relating to the App

8.2 Maximum Liability

Our total liability for any claims under these Terms is limited to $0 (zero dollars) as this is a free service with no financial transactions.

8.3 Essential Basis

The limitations in this section are an essential basis of the agreement between you and NeuEra Apps.

9. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless NeuEra Apps, its operators, and affiliates from any claims, losses, damages, liabilities, including legal fees, arising from:

• Your use or misuse of the App
• Your violation of these Terms
• Your violation of any laws or regulations
• Inaccurate data you enter or export
• Fraudulent use of App data for tax or reimbursement purposes
• Your violation of any third-party rights

10. TERMINATION

10.1 Your Rights

You may stop using Odometer at any time by:

• Simply ceasing to use the App
• Uninstalling the App from your device

10.2 Effect of Termination

When you uninstall Odometer:

• All App data on your device is permanently deleted
• Exported CSV and PDF files remain where you saved them
• Your license to use the App terminates

10.3 Survival

Sections relating to disclaimers, limitation of liability, indemnification, and governing law survive termination.

11. GOVERNING LAW & DISPUTES

11.1 Governing Law

These Terms are governed by the laws of the State of California, United States, without regard to conflict of law principles.

11.2 Dispute Resolution

• Binding Arbitration: Unresolved disputes will be settled by binding arbitration
• No Class Actions: You agree to bring claims only in your individual capacity

12. GENERAL PROVISIONS

12.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and NeuEra Apps regarding Odometer.

12.2 Severability

If any provision is found unenforceable, the remaining provisions continue in full force.

12.3 No Waiver

Our failure to enforce any provision is not a waiver of that provision.

12.4 Assignment

You may not assign these Terms. We may assign our rights to any successor or acquirer.

12.5 Updates to App

We may release updates to Odometer at our discretion. We are not obligated to provide updates, support, or maintenance.

You agree to comply with all applicable export laws and regulations.
