Kalum Terms of Use
Welcome to Kalum. These Terms of Use ("Terms") govern your access to and use of the Kalum mobile application and related services (collectively, the "Service") operated by NeuEra Apps ("we," "our," or "us").
Please read these Terms carefully before using the Service. By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.
1. Acceptance of Terms
By creating an account, accessing, or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. We may modify these Terms at any time, and such modifications will be effective immediately upon posting. Your continued use of the Service after any modification constitutes your acceptance of the modified Terms.
2. Eligibility
To use the Service, you must:
- Be at least 18 years of age
- Have the legal capacity to enter into a binding agreement
- Not be prohibited from using the Service under applicable law
- Reside in a country where the Service is available
By using the Service, you represent and warrant that you meet all eligibility requirements. If you do not meet these requirements, you must not access or use the Service.
3. Account Registration
3.1 Account Creation
To use the Service, you must create an account by verifying your phone number through Firebase Authentication. You agree to:
- Provide accurate, current, and complete information
- Maintain the security of your account credentials
- Notify us immediately of any unauthorized access to your account
- Accept responsibility for all activities that occur under your account
3.2 One Account Per Person
You may only create one account. Creating multiple accounts may result in termination of all your accounts.
3.3 Account Security
You are responsible for safeguarding your account. We are not liable for any loss or damage arising from your failure to maintain the security of your account.
4. Service Description
Kalum is a prepaid Voice over Internet Protocol (VoIP) calling service that enables you to make outbound voice calls to telephone numbers worldwide.
4.1 What Kalum Provides
- Outbound voice calls to 200+ countries via the public telephone network
- Credit-based prepaid calling (no subscriptions or contracts)
- Call history and transaction records
- Secure payment processing through Stripe
4.2 What Kalum Does Not Provide
- Inbound calling capabilities
- Conference calling
- Call recording or voicemail
- Text messaging (SMS/MMS)
- Emergency calling services (see Section 8)
4.3 Service Availability
We strive to maintain Service availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, upgrades, or circumstances beyond our control.
5. Billing and Payment
5.1 Prepaid Credits
Kalum operates on a prepaid credit system. You must purchase credits before making calls. Credits are applied to your account immediately upon successful payment.
5.2 Credit Packages

5.3 Call Rates and Billing
- Call rates vary by destination country and are displayed before you initiate a call
- Calls are billed in one-minute increments, rounded up to the nearest minute
- A minimum of one minute is charged for any connected call
- Credits are deducted only after a call is completed
- Failed, busy, or unanswered calls are not charged
5.4 Minimum Balance Requirement
To initiate a call, your account must have sufficient credits to cover an estimated 10 minutes at the destination's per-minute rate. This helps ensure uninterrupted calls.
5.5 Credits Do Not Expire
Purchased credits remain in your account indefinitely and do not expire, as long as your account remains active.
5.6 Rate Changes
We reserve the right to modify call rates at any time. Rate changes will be displayed in the app before you initiate calls. Continued use of the Service after rate changes constitutes acceptance of the new rates.
6. Refund Policy
6.1 Refund Eligibility
You may request a refund of unused credits within 7 days of purchase, subject to the following conditions:
- The credits have not been used for any calls
- The refund request is made within 7 days of the original purchase
- You have not previously received a refund for the same purchase
6.2 Non-Refundable Items
The following are non-refundable:
- Credits that have been used for completed calls
- Partial credit balances (unused portion of partially used purchases)
- Credits after the 7-day refund window has passed
6.3 Refund Process
To request a refund:
- Contact us at hello@neuera.app within 7 days of purchase
- Provide your account phone number and transaction details
- Refunds will be processed to your original payment method within 5-10 business days
6.4 Account Closure Refunds
If you close your account with unused credits:
- Credits purchased within the last 7 days are eligible for refund
- Credits purchased more than 7 days ago are forfeited
7. Prohibited Uses
You agree not to use the Service to:
7.1 Illegal Activities
- Engage in any activity that violates local, state, national, or international law
- Harass, threaten, stalk, or intimidate any person
- Transmit fraudulent, defamatory, or obscene content
- Impersonate any person or entity
7.2 Technical Abuse
- Use automated systems (bots, scripts) to make calls
- Attempt to gain unauthorized access to our systems
- Interfere with or disrupt the Service or servers
- Reverse engineer, decompile, or disassemble the Service
- Circumvent rate limits or security measures
7.3 Commercial Misuse
- Resell, redistribute, or commercially exploit the Service without authorization
- Use the Service for telemarketing, robocalls, or mass calling
- Use the Service to operate a call center without prior written approval
7.4 Telecommunications Violations
- Make calls that violate telecommunications regulations in any jurisdiction
- Engage in caller ID spoofing or misrepresentation
- Use the Service in connection with any illegal scheme
Violation of these prohibited uses may result in immediate account termination without refund.
8. Emergency Services Disclaimer
IMPORTANT: KALUM IS NOT A REPLACEMENT FOR TRADITIONAL TELEPHONE SERVICE AND CANNOT BE USED FOR EMERGENCY CALLS.
8.1 No Emergency Calling
The Service does not support calls to emergency services, including but not limited to:
- 911 (United States and Canada)
- 112 (European Union)
- 999 (United Kingdom)
- Other local emergency numbers worldwide
8.2 Your Responsibility
You must maintain access to a traditional telephone service (landline or mobile) or other means to contact emergency services. Do not rely on Kalum for emergency communications.
8.3 Limitation of Liability
We are not liable for any damages, injuries, or losses resulting from your inability to contact emergency services through the Service.
9. Intellectual Property
9.1 Our Intellectual Property
The Service, including its design, features, content, and functionality, is owned by NeuEra Apps and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our prior written consent.
9.2 Trademarks
"Kalum" and our logo are trademarks of NeuEra Apps. You may not use our trademarks without prior written permission.
9.3 Feedback
If you provide feedback, suggestions, or ideas about the Service, you grant us a non-exclusive, royalty-free, perpetual license to use such feedback for any purpose.
10. Third-Party Services
The Service integrates with third-party services:

11. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
- WARRANTIES OF MERCHANTABILITY
- FITNESS FOR A PARTICULAR PURPOSE
- NON-INFRINGEMENT
- ACCURACY OR COMPLETENESS OF CONTENT
WE DO NOT WARRANT THAT:
- The Service will be uninterrupted, secure, or error-free
- Call quality will meet your expectations
- All calls will connect successfully
- The Service will be available at all times or in all locations
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:
12.1 Exclusion of Damages
WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:
- Loss of profits, data, or goodwill
- Service interruption
- Missed or dropped calls
- Unauthorized access to your account
- Errors or inaccuracies in the Service
12.2 Cap on Liability
OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE SIX (6) MONTHS PRECEDING THE CLAIM.
12.3 Basis of the Bargain
THE LIMITATIONS AND EXCLUSIONS IN THIS SECTION APPLY REGARDLESS OF THE THEORY OF LIABILITY (CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE) AND EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
13. Indemnification
You agree to indemnify, defend, and hold harmless NeuEra Apps, its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to:
- Your use of the Service
- Your violation of these Terms
- Your violation of any rights of another party
- Any calls made using your account
14. Termination
14.1 Termination by You
You may terminate your account at any time by contacting us at hello@neuera.app. Upon termination:
- Credits purchased within 7 days may be refunded (see Section 6)
- Credits purchased more than 7 days ago are forfeited
- Your account data will be deleted in accordance with our Privacy Policy
14.2 Termination by Us
We may suspend or terminate your account immediately, without prior notice, if:
- You violate these Terms
- You engage in fraudulent or abusive behavior
- You fail to pay for credits (chargeback or payment dispute)
- We are required to do so by law
- We discontinue the Service
14.3 Effect of Termination
Upon termination:
- Your right to use the Service immediately ceases
- We may delete your account data
- Provisions that by their nature should survive termination will survive (including Sections 11, 12, 13, 15, and 16)
15. Dispute Resolution
15.1 Informal Resolution
Before filing any formal legal action, you agree to first contact us at hello@neuera.app to attempt to resolve the dispute informally. We will attempt to resolve the dispute within 30 days.
15.2 Binding Arbitration
If informal resolution fails, any dispute arising out of or relating to these Terms or the Service shall be resolved by binding arbitration administered by the American Arbitration Association in accordance with its Consumer Arbitration Rules.
15.3 Class Action Waiver
YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION.
15.4 Small Claims Exception
Notwithstanding the above, either party may bring an individual action in small claims court for disputes within the court's jurisdiction.
15.5 Opt-Out
You may opt out of the arbitration and class action waiver provisions by sending written notice to hello@neuera.app within 30 days of your first use of the Service.
16. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.
17. General Provisions
17.1 Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and NeuEra Apps regarding the Service.
17.2 Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
17.3 Waiver
Our failure to enforce any right or provision of these Terms will not be considered a waiver of such right or provision.
17.4 Assignment
You may not assign or transfer these Terms without our prior written consent. We may assign our rights and obligations without restriction.
17.5 Force Majeure
We are not liable for any failure or delay in performing our obligations due to circumstances beyond our reasonable control, including natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes, or shortages of transportation, facilities, fuel, energy, labor, or materials.
18. Changes to These Terms
We may revise these Terms at any time by posting the updated Terms within the app. The "Last Updated" date at the top will indicate when the Terms were last revised. Your continued use of the Service after any changes constitutes your acceptance of the new Terms.
Material changes will be communicated through:
- In-app notification
- Email (if you have provided one)
